Decided September 29, 1947.

An action for damages for failure and alleged refusal of an automobile dealer to deliver to plaintiff a new car, for which he had given an order and upon the purchase price of which he had made a payment, in accordance with a contract with the dealer. Judgment for plaintiff.

Error to the District Court of Alamosa County, Hon. Joseph H. Thomas, Judge.

Mr. MERLE M. MARSHALL, for plaintiffs in error.

No appearance for defendant in error.


Judgment affirmed en banc without written opinion.
