This case is calendared for trial at the Trial Session of the Court scheduled to commence on January 23, 2023, in Dallas, Texas.

On December 15, 2022, respondent filed with the Court a Motion to Dismiss for Failure to Properly Prosecute. On December 30, 2022, the Court issued an Order to Show Cause requiring a response from petitioner on or before January 17, 2023, and setting the motion for hearing during calendar call. On January 13, 2023, the parties filed with the Court a Proposed Stipulated Decision.

Upon due consideration, and for cause, it is

ORDERED that Respondent's Motion to Dismiss for Failure to Properly Prosecute, filed with the Court on December 15, 2022, is denied as moot. It is further

ORDERED that the Court's Order to Show Cause, issued December 30, 2022, is hereby discharged.
