ORDER STRIKING PLAINTIFFS' LAY WITNESS LIST


This case is before the Court upon Plaintiff's filing of a purported lay witness list (Doc. No. 68).

Under the Scheduling Order in this case, lay witness lists were to have been filed not later than January 31, 2006. Plaintiff never sought or obtained any extension of time nor has he shown any cause for late filing. More importantly, his list does not comply with the Scheduling Order in that it does not identify any individuals except for Dr. William A. Cole and it does not provide a synopsis of what the witnesses will testify to. All Plaintiff has done is to say he will call as witnesses "all parties named in the litigation." There are thirty-eight individuals named as Defendants in the case, most of them with only a name and a number.

In sum, Plaintiff's lay witness list is two months late without excuse or permission and does not provide any useful information. It is accordingly stricken.
