Opinion

No. 02 Civ. 5959 (RMB) (MHD).

June 6, 2005

Alecia Walters, Esq., Assistant Corporation Counsel for the City of New York Law Department, New York.

MEMORANDUM AND ORDER

The district court has requested that we advise it whether further discovery should be made available to plaintiff before she responds to defendant's summary judgment motion. We have reviewed our files and received a brief submission from defendant's counsel on this question. (See June 2, 2005 letter to the Court from Assistant Corporation Counsel Alecia Walters.) We are aware of no instance in which defendants refused to provide requested information to plaintiff during discovery, nor did we ever receive any request by plaintiff for relief in connection with her discovery efforts. Accordingly, we see no basis for requiring further, unspecified discovery at this time.

SO ORDERED.
