380 So. 2d 1170 (Fla. Dist. Ct. App. 1980)

Opinion

No. 77-2248.

March 12, 1980.

Appeal from Circuit Court, Broward County; W. Herbert Moriarty, Judge.

Paul R. Regensdorf and Frank E. Maloney, Jr., of Fleming, O'Bryan Fleming, Fort Lauderdale, for appellant.

Edward G. Rubinoff, of Preddy, Kutner Hardy, and Marc Cooper, of Greene Cooper, Miami, for appellee Diplomat Hotel, Inc.

Since oral argument in this case the Florida Supreme Court issued its opinion in Houdaille Industries, Inc. v. Edwards, 374 So.2d 490 (Fla. 1979) which we find controlling. Accordingly, this cause is affirmed.

DOWNEY, C.J., and MOORE and BERANEK, JJ., concur.
