[PRIPOSED] ORDER OF DISMISSAL, PURSUANT TO STIPULATION OF PARTIES


Pursuant to the stipulation of the parties, IT IS HERJEBY ORDERED that Plaintiff Sharper Image Corporation's ("Sharper Image") Complaint should be dismissed with prejudice, and Defendant Brookstone Company, Inc.'s ("Brookstone") Counterclaim should be dismissed with prejudice, except that Brookstone shall not be precluded from challenging the validity and/or unenforceablity of the 088 patent in the future, should said patent ever be asserted against Brookstone for any other products, with each party bearing its own costs and attorneys' fees.
