Sharif v. Alford

District Court of Appeal of Florida, First District
Feb 18, 1994
631 So. 2d 1141 (Fla. Dist. Ct. App. 1994)

Opinion

No. 92-3686.

February 18, 1994.

An appeal from the Circuit Court for Bradford County; Chester Chance, Judge.

Tony Sharif, pro se.

Robert A. Butterworth, Atty. Gen., Tallahassee, for appellee.

The record demonstrates that the appellant filed a document entitled "Answer for Definite Statement" which appellees admitted was responsive to their motion for a more definite statement. The trial court therefore erred in striking appellant's pleadings and dismissing the complaint with prejudice for failing to file a more definite statement.

REVERSED and REMANDED for further proceedings.

ERVIN and BENTON, JJ., concur.
