DECISION & ORDER ON MOTION

Separate motions by the respondent Bijan Golyan and the respondents Raz Winiarsky, Richard Seldes, and North Shore University Hospital, to dismiss an appeal from an order of the Supreme Court, Kings County, dated April 12, 2012, on the ground that no appeal lies from an order determining a motion in limine. Application by the appellant to withdraw the appeal.

Upon the papers filed in support of the motions and the application, and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the application is granted and the appeal is deemed withdrawn, without costs or disbursements; and it is further,

ORDERED that the motions are denied as academic.
