Decided January 14th, 1930.

Divorce — Adultery — Condonation.

The burden of proof as to the condonation of adultery is on the party asserting it.

Where both parties are guilty of adultery, neither is entitled to a divorce.

Appeal from the Circuit Court for Frederick County (NEWMAN, J.).

Bill for divorce by Emma Blanche Shafer against Ira H. Shafer. From a decree in favor of defendant on his crossbill, plaintiff appeals. Affirmed in part and reversed in part.

The cause was submitted on briefs to BOND, PATTISON, URNER, ADKINS, OFFUTT, DIGGES, PARKE, and SLOAN, JJ.
