MOTION DECISION

Present - Hon. Sallie Manzanet-Daniels, Justice Presiding, Troy K. Webber Angela M. Mazzarelli Peter H. Moulton Manuel J. Mendez, Justices.

Plaintiffs-respondents-appellants having moved for an extension of time in which to perfect their appeal taken from an order of the Supreme Court, New York County, entered on or about July 17, 2020 (Case No. 2020-03584) in accordance with the stipulated briefing schedule for all consolidated appeals related to this matter, (Case Nos. 2020-03584, 2020-03869, 2020-04815), Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied as academic based upon the extension of time previously granted, sua sponte, to the plaintiffs to the October 2021 Term in accordance with the parties briefing schedule dated March 30, 2021 (See M-2021-01372, entered May 27, 2021). The appeals perfected by the Hovnanian defendants are, sua sponte, adjourned to said October 2021 Term of this Court.
