Severin v. Benenati

Appellate Division of the Supreme Court of New York, Second Department
Jun 1, 1998
251 A.D.2d 316 (N.Y. App. Div. 1998)

Opinion

June 1, 1998

Appeal from the Supreme Court, Kings County (Shaw, J.).

Ordered that the judgment is affirmed, with costs.

The jury's award of damages for the plaintiffs torn rotator cuff injury did not deviate from what would be reasonable compensation (CPLR 5501 [c]; see, Sescila v. Garine, 225 A.D.2d 684).

The plaintiffs remaining contention is without merit.

O'Brien, J. P., Pizzuto, Joy and Florio, JJ., concur.
