STIPULATION AND ORDER


IT IS HEREBY STIPULATED AND AGREED, by and between the undersigned attorneys for Plaintiff and Defendant BANKERS TRUST COMPANY, as follows:

1. Plaintiff's time to respond to Bankers Trust Company's Motion for Assessment of Costs and Expenses Against Plaintiff (Dk. No. 207) (the "Motion") is extended from March 7, 2005, to March 21, 2005.

2. This is the first extension of time to respond to the Motion.

3. This stipulation is without prejudice to, and shall have no effect upon, Plaintiff's pending request to hold the Motion in abeyance.

SO ORDERED.
