United States District Court, S.D. Ohio, Eastern Division
Apr 21, 2009
Case No. C2-08-667 (S.D. Ohio Apr. 21, 2009)

Opinion

Case No. C2-08-667.

April 21, 2009

ORDER

As set forth more fully on the record during the hearing on April 21, 2009, the Court takes the matter of the Receiver's Motions for Turnover and Contempt under advisement. With regard to the pending lawsuit in New York, specifically, Elite Shine Group, Ltd. v. JP Morgan Chase Bank, N.A., Case No. 1:09-cv-1929 (S.D. N.Y.), however, the Court hereby ENJOINS the plaintiffs in that case (Intervenors in this action) from proceeding without permission of this Court. The Court concludes that this injunction is consistent with its prior Order appointing the Receiver which prohibits all persons from commencing any lawsuit or proceeding affecting the Receiver Estates or doing any act that interferes with the exclusive jurisdiction of this Court over the Receiver Estates. In the event the judge in New York orders the plaintiffs therein to take any affirmative action in the case, then the plaintiffs shall file with this Court a request for an exemption from this injunction.

IT IS SO ORDERED.
