Rehearing Granted June 17, 1944.

Appeal from Superior Court, City and County of San Francisco; Frank T. Deasy, Judge.

Action by Roderick Seckel against Lee W. Allen, Elsie M. Allen, his wife, and others, to recover damages for alleged fraud on plaintiff in the sale to plaintiff of real property. At the end of plaintiff’s case the trial court granted defendants’ several motions for nonsuit, and plaintiff appealed as to all such orders except as to the order granting the motion of defendant Elsie M. Allen.

Order in favor of defendant A. H. Wright affirmed, and orders in favor of other defendants, except Elsie M. Allen, reversed.
