Seaboard Surety Corporation of America v. Hollywood State Bank

Court of Appeal of California, Second District, Division Two
Sep 11, 1936
16 Cal.App.2d 757 (Cal. Ct. App. 1936)

Opinion

Docket No. 11149.

September 11, 1936.

MOTION to dismiss an appeal from a judgment of the Superior Court of Los Angeles County and from an order denying a new trial. Henry M. Willis, Judge. Denied.

The facts are stated in the opinion of the court.

Woodruff, Burr Smith, Philip S. Ehrlich, Philip Grey Smith and L.O. Hatch for Appellant.

Leonard Wilson and Joseph M. Argabrite for Respondent.

[1] This case comes before us upon the respondent's motion to dismiss the appeal on the ground that the notice of appeal was not filed within the time required by law, the contention being that appellant was a day late, and that contention depending in turn on when the order of the trial court was entered in the minutes. The case is very similar to the case of Berman v. Blankenship Motors, 140 Cal.App. 134 [ 34 P.2d 1035], and on the authority of that case the motion is denied.

Wood, J., and Gould, J., pro tem., concurred.
