MARCUS KEITH SCOTT, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the Criminal District Court No. 6 Dallas County, Texas Trial Court Cause No. F22-00187-X

ORDER

ERIN A. NOWELL JUSTICE

We REINSTATE this appeal.

This Court abated the appeal for the trial court to make findings concerning State's exhibits 4 and 6. The trial court held a hearing and found, based on the evidence presented, the recordings on the exhibits could not be uploaded to TAMES because the recordings could not be converted to a format compatible with TAMES without damaging the evidence on the exhibits. The Court adopts the trial court's findings.

We ORDER Norma Rico to file with this Court within TEN DAYS of the date of this order a copy of the CD containing State's exhibit 4 and a copy of the DVD containing State's exhibit 6.

We DIRECT the Clerk to send copies of this order to Norma Rico, Court Reporter; and counsel for all parties.
