MEMORANDUM OPINION


Appellants filed a notice of appeal stating they were appealing the trial court's July 1, 2008 judgment. By letter dated October 30, 2008, this Court notified appellants that the record does not contain the trial court's judgment and that the Dallas County Clerk notified us that there is no judgment dated July 1, 2008. We directed the parties to file letter briefs addressing our jurisdiction absent a final judgment. Appellants neither filed a jurisdictional brief nor otherwise communicated with the Court regarding the appeal.

Appellate courts have jurisdiction over final judgments and such interlocutory orders as the legislature deems appealable. Lehmann v. Har-Con Corp., 39 S.W.3d 191, 195 (Tex. 2001); Ruiz v. Ruiz, 946 S.W.2d 123, 124 (Tex.App.-El Paso 1997, no writ). Because there is no final judgment or otherwise appealable interlocutory order before the Court, we conclude we have no jurisdiction over the appeal.

We further note that although warned failure to pay the $175 filing fee for the appeal would result in the dismissal of the appeal, appellants have not paid the filing fee.

We dismiss the appeal for want of jurisdiction.
