DECISION AND ORDER ON MOTION

Motion for preference, for preliminary injunction pending appeal and for further relief.

Upon the papers filed in support of the motion and the papers filed in response thereto, it is

ORDERED that the motion for a preference is granted, without costs, to the extent that the appeal is set down for the May 2013 term of this Court. The responding brief shall be filed and served on or before April 26, 2013. The reply brief, if any, shall be filed and served on or before May 6, 2013. It is further

ORDERED that the motion for a preliminary injunction and for further relief is denied, without costs.
