Schofman v. de Cardenas

District Court of Appeal of Florida, Third District
Apr 28, 1987
506 So. 2d 58 (Fla. Dist. Ct. App. 1987)

Opinion

No. 86-1770.

April 28, 1987.

An Appeal from the Circuit Court for Dade County; David L. Levy, Judge.

Craig R. Dearr, Hialeah, and Aurelio Durana, Tallahassee, for appellants.

Taylor, Brion, Buker Greene and Arnaldo Velez, Miami, for appellees.

Before SCHWARTZ, C.J., and HENDRY and FERGUSON, JJ.

Appellants appeal a summary judgment entered in favor of appellees. Because the record on appeal reveals that there are issues of material fact which have not been eliminated by the movants for summary judgment, we reverse and remand for further proceedings.

Reversed and remanded.
