Motion by respondent for leave to reargue stated portions of an appeal from an order of the Civil Court of the City of New York, Kings County, entered March 18, 2010, which was determined by decision and order of this court dated February 22, 2012, or, in the alternative, for leave to appeal to the Appellate Division from the decision and order of this court. Cross motion by appellants for leave to reargue stated portions of the appeal or, in the alternative, for leave to appeal to the Appellate Division from the decision and order of this court.
