INSTRUCTIONS, § 8when argumentative instruction will not constitute reversible error. As to whether there is reversible error in instruction which is argumentative in any given case, must depend upon all circumstances and conditions present, and instruction will not constitute reversible error because of argumentativeness if it has not prejudiced opposite party.

Appeal from the Circuit Court of St. Clair county; the Hon. R.W. GRIFFITH, Judge, presiding.

Affirmed. Heard in this court at the May term, 1946.
