The appellee also has filed a motion to dismiss the appeal because of the appellant's failure to prosecute the appeal diligently. The appellant has not responded to the notice to show cause or the motion to dismiss.
Dismissal of this action, therefore, is deemed to be unopposed. Supr. Ct. R. 29(b).
