APPEAL DISMISSED.

Unpublished Opinion is below.

CHRISTOPHER SCHMID, Respondent Below-Appellant, v. DCSE/OLIVIA GRAY, Petitioner Below-Appellee. No. 582, 2000. Supreme Court of Delaware. Submitted: June 18, 2001. Decided: June 22, 2001.

Court Below: Family Court of the State of Delaware, in and for New Castle County. File No. CN98-07281.

ORDER

This 22nd day of June 2001, it appears that the Clerk of the Court issued a notice to the appellant to show cause why this appeal should not be dismissed for his failure to file his opening brief. The appellee also has filed a motion to dismiss the appeal because of the appellant's failure to prosecute the appeal diligently. The appellant has not responded to the notice to show cause or the motion to dismiss.

Dismissal of this action, therefore, is deemed to be unopposed. Supr. Ct. R. 29(b).

NOW, THEREFORE, IT IS ORDERED that the within appeal is DISMISSED.
