Ramsey County District Court File No. 62-CV-22-421
Considered and decided by Johnson, Presiding Judge; Smith, Tracy M., Judge; and Larson, Judge.
ORDER OPINION
TRACY M. SMITH JUDGE
BASED ON THE FILE, RECORD, AND PROCEEDINGS, AND BECAUSE:
1. Appellant Troy K. Scheffler appeals the district court's denial of his application to proceed in forma pauperis (IFP). See Minn. Stat. § 563.01, subd. 3 (2020).
2. Scheffler's IFP application in this case is virtually identical to the IFP application that he submitted to the district court in another case that he recently appealed, Scheffler v. Costco Wholesale Corp., No. A22-0409. Scheffler makes the same arguments here that he made in that appeal. In that appeal, we concluded that the district court erred by denying the IFP application, and we reversed and remanded the case with instructions to grant IFP status. Scheffler v. Costco Wholesale Corp., No. A22-0409 (Minn.App. Sep. 6, 2022).
3. For the reasons stated in our opinion in Scheffler v. Costco Wholesale Corp., No. A22-0409, slip op. at 3-4 (Minn.App. Sept. 6, 2022), we agree with Scheffler that the district court erred by denying his application in this case, and we reverse and remand to the district court with instructions to grant Scheffler's IFP application.
IT IS HEREBY ORDERED:
1. The district court's order is reversed and remanded.
2. Pursuant to Minn. R. Civ. App. P. 136.01, subd. 1(c), this order opinion is nonprecedential, except as law of the case, res judicata, or collateral estoppel.
