This case is calendared for trial at the Trial Session of the Court scheduled to commence on April 17, 2023, at the Celebrezze Federal Building located at 1240 East 9th Street, Room 3013 in Cleveland, Ohio 44199.

On March 27, 2023, respondent filed with the Court a Motion to Dismiss for Lack of Prosecution asking that the Court find in its order that there are deficiencies in income tax for the taxable years 2014, 2015, 2016, 2017, 2018 and 2019, as set forth in the statutory notice dated October 6, 2021, in the amounts of $70,645.00, $70,553.00, $69,993.00, $65,826.00, $52,806.00 and $52,954.00, respectively. Respondent informed the Court that, as of the date of filing, petitioner had been unresponsive.

Upon due consideration, and for cause, it is

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution, filed with the Court on March 27, 2023, is set for hearing at the calendar call on April 17, 2023, at 10:00 a.m. ET, during the Court's Cleveland, Ohio Trial Session. Petitioner is advised that failure to appear at the hearing on April 17, 2023, may result in the Court granting respondent's motion and entering the above-described order and decision against petitioner.
