Schaaf v. State

Supreme Court of Indiana
Jun 24, 1943
221 Ind. 705 (Ind. 1943)

Opinion

No. 27,841.

Filed June 24, 1943.

From the Newton Circuit Court; R.R. Cummings, Judge.

Mary Grace Wells Schaaf was indicted and thereafter filed a motion to be discharged on the ground, among others, that the action of the court in sustaining the State's motion to dismiss the cause was void, to which the State filed a motion to strike. From the action of the court in dismissing the cause and in striking defendant's motion for discharge, she appealed.

Appeal dismissed.

Crumpacker Friedrich, of Hammond, for appellant.

James A. Emmert, Attorney General, Frank Hamilton, First Assistant Attorney General, Frank E. Coughlin, Deputy Attorney General, Charles W. Gannon, of Crown Point, and Henry G. Doherty, of East Gary, for appellee.

The motion of the State to dismiss this appeal presents the same questions as were presented in Mary Grace Wells Schaaf v. State of Indiana, No. 27840 in this court, ante p. 563, 49 N.E.2d 539. On the authority of that case this appeal is dismissed.

NOTE. — Reported in 49 N.E.2d 542.
