ORDER OF DISMISSAL

Deborah Brooks Durden, Judge.

This matter is before the South Carolina Administrative Law Court (Court) pursuant to a request for a contested case hearing, filed on August 4, 2021, relating to the determination by South Carolina Department of Natural Resources (Department) to suspend Respondent's privilege to operate, navigate, steer, pilot or drive a vessel...or moving device due to his refusal to submit to a chemical or breath analysis test on July 5, 2021. On December 23, 2021, Counsel for Respondent sent an e-mail to this Court stating that Respondent was withdrawing his Request for Contested Case Hearing. The Department consents to the withdrawal. Therefore, finding good cause, IT IS HEREBY ORDERED that this matter is DISMISSED with prejudice.

IT IS ALSO ORDERED that the hearing scheduled for Monday, January 10, 2022, at 10:00 a.m. be canceled.

AND IT IS SO ORDERED. 1
