This case is currently calendared for trial at the Session of the Court commencing on November 14, 2022, in Winston-Salem, North Carolina. On October 14, 2022, pursuant to the Court's Standing Pretrial Order served on the parties on July 15, 2022, respondent filed a Status Report, apprising the Court of the then present status of this case. Respondent reports that the Internal Revenue Service Independent Office of Appeals (Appeals) has reached a settlement with petitioner based upon concessions by both parties in this case. Respondent further reports that on October 13, 2022, the Appeals officer requested that respondent prepare the decision document and on October 14, 2022, respondent sent the proposed decision document to the Appeals officer. Respondent also reports that the Appeals officer will mail the document to petitioner and anticipates that a signed decision document will be received and filed by the November 14, 2022, Winston-Salem, North Carolina Trial Session. Upon due consideration, it is hereby
ORDERED that this case is stricken for trial from the November 14, 2022, Winston-Salem, North Carolina Trial Session of the Court. It is further
ORDERED that jurisdiction of this case is retained by this Division of the Court. It is further
ORDERED that the parties shall, on or before November 21, 2022, electronically submit to the Court an agreed stipulated decision document or file status reports, separately or jointly, apprising the Court of the then present status of this case.
