Sanzobrin v. Arthur

Appellate Division of the Supreme Court of New York, Second Department
Jul 10, 1967
28 A.D.2d 921 (N.Y. App. Div. 1967)

Opinion

July 10, 1967

Order of the Supreme Court, Nassau County, dated April 1, 1966, reversed, without costs, and defendants' motion remitted to Special Term for the purpose of holding an immediate trial with respect to the issues raised upon such motion. Although we take judicial notice of the law of a sister State (CPLR 4511, subd. [a]), the circumstances of this case are such that the issues raised should not be summarily disposed of upon affidavits. An immediate trial pursuant to CPLR 3211 (subd. [c]) should be held at which the parties should present experts with respect to the law of Kentucky to assist the court in reaching its decision. Brennan, Acting P.J., Rabin, Hopkins, Benjamin and Nolan, JJ., concur.
