From the 406th Judicial District Court, Webb County, Texas Trial Court No. 2019CRB001398D4 Honorable Oscar J. Hale, Jr., Judge Presiding
ORDER
Irene Rios, Justice
The reporter's record was originally due on January 17, 2023. We granted the court reporter's notification of late record requesting an extension of time to file the reporter's record. After granting the extension, the reporter's record was due on May 15, 2023. However, the court reporter has filed a second notification of late record requesting additional time to file the reporter's record. The request is GRANTED.
We, therefore, ORDER Alison R. Ziskind to file the reporter's record on or before June 26, 2023.
NO FURTHER EXTENSIONS OF TIME WILL BE GRANTED. IF THE REPORTER'S RECORD IS NOT RECEIVED BY SUCH DATE, AN ORDER MAY BE ISSUED DIRECTING THE COURT REPORTER TO APPEAR AND SHOW CAUSE WHY SHE SHOULD NOT BE HELD IN CONTEMPT FOR FAILING TO FILE THE RECORD.
WHILE WE UNDERSTAND THAT THERE ARE COMPETING DEMANDS ON THE COURT REPORTER'S TIME, THESE DEMANDS CANNOT JUSTIFY SUCH A LENGTHY DELAY AND POTENTIAL PREJUDICE TO APPELLANT'S RIGHTS. IF ALISON R. ZISKIND IS UNABLE TO PERFORM ALL OF HER DUTIES AND COMPLETE A RECORD IN A TIMELY MANNER, SHE MUST TAKE WHATEVER STEPS ARE NECESSARY, INCLUDING REQUESTING A SUBSTITUTE REPORTER OR HIRING COMPETENT ASSISTANCE, TO FILE THE RECORD BY THE DATE ORDERED.
