DECISION & ORDER ON MOTION

Motion by respondent to dismiss an appeal from an order of the Civil Court of the City of New York, Kings County, entered August 30, 2017, for failure to perfect. By decision and order on motion of this court dated April 12, 2018, appellant was directed to perfect the appeal by May 14, 2018. Appellant perfected the appeal on May 9, 2018.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is denied; and it is further,

ORDERED, on the court's own motion, that respondent's time to serve and file a respondent's brief is enlarged to 21 days from the date of this decision and order on motion; and it is further,

ORDERED that appellant, if so advised, may serve and file a reply brief within 14 days after the service of the respondent's brief.
