ORDER MODIFYING MAJORITY OPINION

THE COURT:

It is ordered that the opinion filed herein on April 24, 2008, be modified in the following particulars:

1. On page 13, second sentence of the first full paragraph, the words “Southern Pacific” are changed to “Rancho Penasquitos” so the sentence reads:

Thus, unlike in Rancho Penasquitos, the condemning authority is not also the zoning authority.

This modification does not effect a change in the judgment.
