Pro Se Motion for Extension of Brief Time [Circuit Court of Benton County, CR 2006-802(A)], Motion Moot.


Appellant Serafin Sandoval-Vega has lodged a pro se appeal here from the circuit court's denial of a pro se postconviction petition pursuant to Arkansas Rule of Criminal Procedure 37.1. Now before us is his pro se motion for an extension of time to file his brief-in-chief.

Appellant's brief was due to be filed in this court on May 26, 2009. Appellant timely tendered the brief on May 8, 2009, and the brief was returned to him for correction. The corrected brief was due to be filed by June 8, 2009. At the same time he tendered the brief, appellant filed the instant motion for extension of time, seeking until June 15, 2009, to file the brief. In the motion, appellant contends that he has not been supplied with a copy of his transcript that is necessary to prepare the abstract portion of the brief. Thereafter, on June 8, 2009, appellant filed his brief, abstract and addendum.

As appellant timely filed the brief, the motion for extension of time is moot.

Motion moot.
