DECISION & ORDER ON MOTION

Motion by appellant to be restored to possession of the first-floor apartment and/or the basement at 106-41 Liverpool Street, Jamaica, N.Y. pending the determination on an appeal from a decision of the Civil Court of the City of New York, Queens County, entered July 27, 2016, and for a stay.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion seeking to be restored to possession of the first-floor apartment pending the determination of the appeal is granted and respondent is directed to restore appellant to possession of the first-floor apartment forthwith; and it is further,

ORDERED that appellant is directed to perfect the appeal on or before January 6, 2017; and it is further,

ORDERED that the motion is otherwise denied.
