Sanders v. Laird

District Court of Appeal of Florida, Second District
Jun 28, 1996
677 So. 2d 905 (Fla. Dist. Ct. App. 1996)

Opinion

No. 94-02929.

June 28, 1996.

Appeal from the Circuit Court for Hillsborough County; Debra K. Behnke, Judge.

Neil H. Sanders, II, pro se.

Mark A. Neumaier, Tampa, for Appellee.

In this appeal from a final judgment of dissolution of marriage, the husband argues that the trial court erred in dismissing the husband's counterpetition for lack of subject matter jurisdiction.

We believe the trial court did have subject matter jurisdiction to consider the counterpetition and erred in entering the order of dismissal. Accordingly, we reverse and remand for further proceedings.

SCHOONOVER and WHATLEY, JJ., concur.
