JOHNNY SANCHEZ, et al., Petitioners, v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Mark V. Holmes Judge

These cases were on the Court's January 27, 2014 trial calendar for San Francisco, California. The Court put them on a long-term status-report track to see what happens in a related criminal case and in petitioners' ongoing negotiations with IRS Appeals, and to allow respondent to decide petitioner Johnny Sanchez's request for innocent-spouse relief. It turned out these related issues also depended on the outcome of the criminal trial. Then the pandemic started delaying that criminal trial. In a phone call with the parties on June 16, 2022 we learned that the logjam may have broken with a plea deal that will mean dismissal of all charges against Mr. Sanchez and probation for Mrs. Sanchez. Respondent will now be able to engage in productive consideration of the innocent-spouse issue, and have new information with which to discuss a reasonable settlement of the deficiency issue. It is therefore

ORDERED that respondent file another status report on or before October 21, 2022 to describe the parties' progress toward settlement and whether the state-court case has finally been resolved.
