An appeal having been taken from the order of the Supreme Court, Bronx County, entered on or about May 4, 2015, And defendant New York Elevator Company having moved to dismiss the aforesaid appeal by motion (M-6258) and subsequent amended motion (M-84), And defendant third-party plaintiff White Plains Galleria Limited Partnership having cross-moved to dismiss the appeal (M-28), Now, upon reading and filing the papers with respect to the motions and cross motion, and due deliberation having been had thereon, It is ordered that the motions and cross motion are granted and the appeal is dismissed.
