Sam v. PRK Enterprises

Court of Appeals of Texas, Ninth District, Beaumont
May 20, 2010
No. 09-10-00051-CV (Tex. App. May. 20, 2010)

Opinion

No. 09-10-00051-CV

Opinion Delivered May 20, 2010.

On Appeal from the 172nd District Court Jefferson County, Texas Trial, Cause No. E-184,784.

Before McKEITHEN, C.J., KREGER and HORTON, JJ.

MEMORANDUM OPINION

The appellants, Sam the Eagle Webblog and Operation Kleinwatch Webblog, filed a motion to dismiss this appeal and to transfer the record of this appeal to the file of the companion mandamus proceeding.

Sam the Eagle Webblog and Operation Kleinwatch Webblog are pseudonyms adopted by two individuals whose real identities are unstated in the appellate record.

We denied the appellants' petition for writ of mandamus in a previously issued opinion. See In re John Does 1 and 2, No. 09-10-00189-CV, 2010 WL 1711499, at *1 (Tex. App.-Beaumont Apr. 29, 2010, orig. proceeding) (mem. op.). Due to the disposition of the mandamus proceeding, the request to transfer the appellate record to the mandamus proceeding is denied as moot.

The motion to dismiss is voluntarily made by the appellants prior to any decision of this Court. See TEX. R. APP. P. 42.1(a)(1). No other party filed notice of appeal. We grant the motion to dismiss and dismiss the appeal.

APPEAL DISMISSED.
