This case was set on the calendar for the remote Trial Session of the Court at Boston, Massachusetts, on April 25, 2022. On February 24, 2022, counsel for respondent filed with the Court a Motion for Summary Judgment. This case was called from the calendar on April 25, 2022. There was no appearance by or on behalf of petitioner. Counsel for respondent appeared and was heard. On April 6, 2022, the Court issued an order setting this case for time and date certain of April 25, 2022, at 01:30 pm (EST). Counsel for respondent represented to the Court that petitioner was unable to appear before the Court during this Boston, Massachusetts session for various reasons.
By order served April 29, 2022, jurisdiction was retained by the undersigned and this case was continued. Further, respondent's Motion for Summary Judgment was taken under advisement and the Court directed the parties to file a joint status report by May 25, 2022. On May 25, 2022, respondent filed a Status Report informing the Court that petitioner's power of attorney told respondent that petitioner had continuing health problems and requested that any hearings on the matter be postponed. On June 21, 2022, the Court held a conference call with the parties and requested that respondent file a status report by July 21, 2022. Upon due consideration and for cause, it is
ORDERED that respondent's Motion for Summary Judgment filed on February 24, 2022, remains under advisement. It is further
ORDERED that, on or before September 2, 2022, the parties shall submit stipulated decision documents or file a joint status report informing the Court of the then-present status of the case.
