Respondent-appellant having applied for permission to proceed as a poor person and for assignment of counsel on the appeal taken herein from a decision of the Family Court, Herkimer County, dated December 26, 2017,

Now, upon reading and filing the certification of Joshua Bannister, Esq., dated January 3, 2018, and due deliberation having been had thereon,

It is hereby ORDERED that the appeal is dismissed on the ground that no appeal lies from a decision (see Kuhn v Kuhn, 129 AD2d 967, 967 [4th Dept 1987]), and

It is further ORDERED that application is dismissed.
