MEMORANDUM OPINION


By letter dated November 5, 2009, this Court notified appellant that his brief was overdue. We directed appellant to file, within ten days, both his brief and a motion to extend time to file the brief. We further warned appellant that if he did not comply, we would dismiss the appeal without further notice. See Tex. R. App. P. 38.8(a)(1), 42.3. To date, appellant has not filed his brief or an extension motion. Accordingly, we dismiss the appeal.
