22) (the Act). Plaintiffs filed a motion for summary judgment asking the trial court to rule in their favor on the issue of liability under count I. The trial court initially denied the motion, but later granted the motion after the plaintiffs' filed a motion for reconsideration. The defendants appealed and the appellate court, with one justice dissenting, reversed the judgment of the circuit court. ( 200 Ill. App.3d 442.) This court allowed plaintiffs' petition for leave to appeal (107 Ill.2d R. 315).
