Rust v. State

Court of Appeals of Texas, Fifth District, Dallas
Jan 15, 2009
No. 05-08-00880-CR (Tex. App. Jan. 15, 2009)

Opinion

No. 05-08-00880-CR

Opinion Filed January 15, 2009.

On Appeal from the 204th Judicial District Court, Dallas County, Texas, Trial Court Cause No. F04-16073-MQ.

Before Chief Justice THOMAS and Justices FRANCIS and MURPHY.

MEMORANDUM OPINION

George Robert Rust entered a negotiated plea of guilty to the offense of indecency with a child. Pursuant to the plea bargain, the trial court deferred adjudication of appellant's guilt and placed him on community supervision for seven years. On appeal, the trial court has entered a rule 25.2(d) certification, supported by the record, stating appellant has no right to appeal. See Tex. R. App. P. 25.2(d); Dears v. State, 154 S.W.3d 610, 614-15 (Tex.Crim.App. 2005); Mercer v. State, 262 S.W.3d 810, 811 (Tex.App.-Houston [1st Dist.] 2008, no pet.).

Accordingly, we dismiss the appeal for want of jurisdiction.
