The portion of the amended judgment dated April 4, 2004, awarding damages to the plaintiff on his claim of conversion is vacated, and the case is remanded to the Superior Court for a new trial on that issue consistent with the memorandum and order of the Appeals Court. The amended judgment is otherwise affirmed.
