HAROLD A. RUMZEK, Appellant, v. BRYAN D. LUCCHESI, Appellee.

Appeal from the 352 District Court of Tarrant County, Texas (TC# 352-265227-13) ORDER

Pending before the Court is Appellant's motion requesting an extension of time to file his brief and for guidance from the Court related to preparation of the appendix. The request for an extension is granted and Appellant's brief is now due July 22, 2015. Unless voluminous or impracticable, the appendix should include the items listed in TEX.R.APP.P. 38.1(k)(1) and the appendix should be combined with the brief into a single document as required by TEX.R.APP.P. 9.4(j)(4). The appendix may also contain other items pertinent to the issues presented for review if the items are not voluminous. TEX.R.APP.P. 38.1(k)(2). The brief Appellant submitted for filing on June 19, 2015 was nearly 800 pages in length because the appendix contained voluminous documentary evidence. Further, several of the items included in the appendix were not properly redacted as required by TEX.R.APP.P. 9.9. Consequently, the Court rejected the brief. Due to the volume of the documentary evidence included in the appendix, the Court requests that the appendix be prepared without those items.

IT IS SO ORDERED this 22 day of June, 2015.

PER CURIAM Before McClure, C.J., Rodriguez and Hughes, JJ.
