ORDER

On order of the Court, the applications for leave to appeal the August 17, 2023 judgment of the Court of Appeals are considered. We direct the Clerk to schedule oral argument on the applications. MCR 7.305(H)(1). The parties shall file supplemental briefs in accordance with MCR 7.312(E), addressing whether: (1) the Fire Fighters and Police Officers Retirement Act, MCL 38.551 et seq. authorizes municipalities to fund health insurance and other benefits to their retired police and firefighters; (2) Act 28 of 1966 (MCL 38.571 and MCL 38.572) provides pre-Headlee Amendment authorization for a municipality to increase retirement benefits to retired police and firefighters, including healthcare benefits; and (3) the phrase "retirement system" in MCL 38.552(1) should be interpreted by reference to the definition of "retirement system" in MCL 38.2803 of the Protecting Local Government Retirement and Benefits Act, MCL 38.2801 et seq.

The total time allowed for oral argument shall be 40 minutes: 20 minutes for the plaintiffs, and 20 minutes for the defendants, to be divided at their discretion. MCR 7.314(B)(2).

The Michigan Municipal League and the Michigan Townships Association are invited to file briefs amicus curiae. Other persons or groups interested in the determination of the issues presented in this case may move the Court for permission to file briefs amicus curiae. Motions for permission to file briefs amicus curiae and briefs amicus curiae regarding these cases should be filed in Ruman v City of Warren Michigan, Docket No. 166329, only and served on the parties in both cases.
