On review of submissions pursuant to section 500.11 of the Rules, order modified, with costs to defendant Cheek against the plaintiffs, by granting defendant Cheek's motion for summary judgment dismissing the complaint as against her, and, as so modified, affirmed, with costs to plaintiffs against the Bannister defendants, and certified question answered in the negative, in a memorandum.
