ORDER ADOPTING REPORT AND RECOMMENDATION and DISMISSING PETITION FOR A WRIT OF HABEAS CORPUS


Came this day for consideration the petition for a writ of habeas corpus filed by petitioner DAVID LEE ROWE. On June 20, 2001, the United States Magistrate Judge issued a Report and Recommendation in this cause, recommending therein that the petition for a writ of habeas corpus be dismissed for want of prosecution, specifically noting petitioner's failures to comply with Court Orders. No objections to the Report and Recommendation have been filed of record.

Petitioner filed objections on June 29, 2001, but said objections were unfiled due to various deficiencies on July 2, 2001. Petitioner has not properly refiled his objections as of this date.

The undersigned United States District Judge has made an independent examination of the record in this case and has examined the Report and Recommendation of the Magistrate Judge. The District Judge is of the opinion the Magistrate Judge's Report and Recommendation should be, and hereby is, ADOPTED. Accordingly, the petition for a writ of habeas corpus filed by petitioner is hereby DISMISSED.

LET JUDGMENT BE ENTERED ACCORDINGLY.

The United States District Clerk is directed to mail a copy of this Order to petitioner and to each attorney of record by first class United States mail.

IT IS SO ORDERED.
