This case is currently calendared for trial at the Session of the Court commencing on November 28, 2022, in Los Angeles, California. On November 4, 2022, pursuant to the Court's Standing Pretrial Order served on the parties on July 22, 2022, respondent filed a Status Report, apprising the Court of the then present status of this case. Respondent reports that on October 25, 2022, petitioners' power of attorney orally agreed to concede the deficiencies in income tax and penalties asserted against petitioners as specified in the notice of deficiency issued to them for the 2017 and 2018 taxable years (which are the years at issue). Respondent also reports that on October 27, 2022, he prepared and mailed to petitioners a proposed stipulated decision document for their review, approval, signature, and return to him. Respondent further reports that as of November 4, 2022, he has not yet received the signed stipulated decision document from petitioners. According to respondent, he anticipates receiving the signed stipulated decision document before the start of the trial session; once received, he will process said document for filing with the Court. ORDERED that this case is stricken for trial from the November 28, 2022, Los Angeles, California Trial Session of the Court. It is further
ORDERED that jurisdiction of this case is retained by this Division of the Court. It is further
ORDERED that the parties shall, on or before December 8, 2022, electronically submit to the Court an agreed stipulated decision document or file status reports, separately or jointly, apprising the Court of the then present status of this case.
