ORDER DISMISSING ACTION WITHOUT PREJUDICE


The above-entitled action was reassigned to the undersigned on July 13, 2004. On March 19, 2004, the judge previously assigned to the case, Magistrate Judge Elizabeth D. Laporte, denied plaintiff's request to proceed in forma pauperis, and ordered him to pay the $150 filing fee no later than March 30, 2004. Judge Laporte also ordered that if plaintiff failed to pay the filing fee, the case would be dismissed without prejudice. To date, plaintiff has not paid the filing fee, and on July 8, 2004, Judge Laporte issued a report and recommendation that the action be dismissed without prejudice.

Accordingly, the above-entitled action is hereby DISMISSED, without prejudice, due to plaintiff's failure to pay the appropriate filing fee.

The Clerk shall close the file.

IT IS SO ORDERED.
