ORDER

Upon due consideration of the records in the above-docketed cases, and for cause, it is

ORDERED that the Order of Dismissal for Lack of Jurisdiction entered on April 11, 2023, in the case at Docket No. 27903-22, is vacated and set aside. It is further

ORDERED that the docket number of the case at Docket No. 27903-22 is amended by adding the letter “S” thereto, which shall now read “Docket No. 27903- 22S”, and the Clerk of the Court is hereafter directed to process this case to trial or other disposition as a “small tax case.” It is further

ORDERED that the Clerk of the Court shall copy the Petition filed on April 11, 2023, at Docket No. 6579-23S and file it as of that same date as a First Amended Petition in petitioner's case at Docket No. 27903-22S. It is further

ORDERED that the Clerk of the Court shall copy the First Amended Petition filed on May 26, 2023, at Docket No. 6579-23S and file it as of that same date as a Second Amended Petition in petitioner's case at Docket No. 27903-22S. It is further

ORDERED that the Clerk of the Court shall copy the Answer to Amended Petition filed on July 11, 2023, at Docket No. 6579-23S and file it as of that same date as an Answer to Second Amended Petition in petitioner's case at Docket No. 27903- 22S. It is further

ORDERED that the filing fee is waived in the case at Docket No. 27903-22S. It is further

ORDERED that the case at Docket No. 27903-22S is calendared for the Boston, Massachusetts, trial session of the Court scheduled to commence at 10:00 a.m. on May 13, 2024, at the McCormack Post Office & Courthouse, 5 Post Office Square, Room 5, 12th Floor, Boston, MA 02109. It is further

ORDERED that, together with this Order, the Clerk of the Court shall serve on the parties in the case at Docket No. 27903-22S copies of (1) the Notice Setting Case for Trial for the May 13, 2024, Boston, Massachusetts, trial session and (2) the Standing Pretrial Order for that trial session.

This Order constitutes official notice to the parties.
